Sorunun \u00e7\u00f6z\u00fcm\u00fc amac\u0131yla ortakl\u0131kla yap\u0131lan g\u00f6r\u00fc\u015fmelerde, alana kamusal kullan\u0131m\u0131n eklenmesi amac\u0131yla opera i\u015flevinin dahil edilmesi konusunda mutabakat sa\u011flanm\u0131\u015f ve buna g\u00f6re revize edilen plan 1999 y\u0131l\u0131n\u0131n sonunda onaylanm\u0131\u015ft\u0131r. 2000 y\u0131l\u0131n\u0131n ba\u015f\u0131nda uygulama imar plan\u0131n\u0131n onaylanmas\u0131 sonras\u0131nda a\u011fustos ay\u0131nda in\u015faat ruhsat\u0131 yeniden d\u00fczenlenmi\u015ftir. Ancak bu plan de\u011fi\u015fikli\u011fine de \u00f6nceki davalarda ileri s\u00fcr\u00fclen ayn\u0131 gerek\u00e7elerle dava a\u00e7\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"605\" height=\"340\" src=\"https:\/\/kalkinmaguncesi.izka.org.tr\/wp-content\/uploads\/2021\/07\/image-17.png\" alt=\"\" class=\"wp-image-927\" srcset=\"https:\/\/kalkinmaguncesi.izka.org.tr\/wp-content\/uploads\/2021\/07\/image-17.png 605w, https:\/\/kalkinmaguncesi.izka.org.tr\/wp-content\/uploads\/2021\/07\/image-17-300x169.png 300w\" sizes=\"auto, (max-width: 605px) 100vw, 605px\" \/><figcaption>Foto\u011fraf 1: G\u00fcn\u00fcm\u00fczde Alan<\/figcaption><\/figure><\/div>\n\n\n\n<p>2001 y\u0131l\u0131nda ortaklardan birinin ili\u015fkili oldu\u011fu \u015firketin borcu nedeniyle Tasarruf Mevduat\u0131 Sigorta Fonu (TMSF) taraf\u0131ndan \u015firkete el konulmu\u015f ve TMSF alan \u00fczerinde yap\u0131lmas\u0131 planlanan projenin ortakl\u0131\u011fa ait olan hissesine sahip olmu\u015ftur. TMSF taraf\u0131ndan ortakl\u0131kta yer alan \u015firketlerden birine d\u0131\u015far\u0131dan y\u00f6netim kurulu atanmas\u0131yla s\u00f6zle\u015fmeye yeni bir taraf eklenmi\u015ftir.<\/p>\n\n\n\n<p>A\u00e7\u0131lan dava kapsam\u0131nda 2001 y\u0131l\u0131nda plan de\u011fi\u015fikli\u011finin y\u00fcr\u00fctmesi durdurulmu\u015f, iki ay sonra da iptal edilmi\u015ftir. Temyiz edilen karar, Dan\u0131\u015ftay taraf\u0131ndan da onanm\u0131\u015ft\u0131r. Bunun \u00fczerine \u0130BB 2003 y\u0131l\u0131nda; y\u00fcksekli\u011fin serbest oldu\u011fu, 4,5 emsale sahip, \u201cKentsel ve B\u00f6lgesel Merkezi \u0130\u015f Alan\u0131 (M\u0130A)\u2013K\u00fclt\u00fcrel Tesisler Alan\u0131\u201d olarak planlanan yeni naz\u0131m imar plan\u0131n\u0131 onaylam\u0131\u015ft\u0131r. Uygulama imar plan\u0131 2004 y\u0131l\u0131nda onaylanm\u0131\u015f ve se\u00e7im sonras\u0131na yeni plan miras olarak b\u0131rak\u0131lm\u0131\u015ft\u0131r. Bu plana g\u00f6re yo\u011funluk 0,5 birim d\u00fc\u015f\u00fcr\u00fclm\u00fc\u015f,&nbsp; bu da mimari projede de\u011fi\u015fiklik gerektirmi\u015f, bunun sonucunda D\u00fcnya Ticaret Merkezi (DTM) projesindeki ikiz kuleler projesinden vazge\u00e7ilmi\u015ftir.<\/p>\n\n\n\n<p>Mahkemeye ta\u015f\u0131nan bu plan i\u00e7in yerel mahkeme bilirki\u015fi raporuna dayanarak davac\u0131lar\u0131n talebini 2004 y\u0131l\u0131nda reddetmi\u015f olsa da temyiz sonucunda 2005 y\u0131l\u0131nda Dan\u0131\u015ftay plan\u0131n iptal edilen \u00f6nceki planlardan farkl\u0131 olmad\u0131\u011f\u0131 ve emsalin 0,5 birim d\u00fc\u015f\u00fcr\u00fclmesinin kentsel yo\u011funlu\u011fu azaltmad\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fc ile yerel mahkemenin karar\u0131n\u0131 bozmu\u015ftur. 2007 y\u0131l\u0131na kadar uzayan temyiz s\u00fcre\u00e7leri sonucunda Dan\u0131\u015ftay hem naz\u0131m imar plan\u0131n\u0131 hem de uygulama imar plan\u0131n\u0131 iptal etmi\u015ftir.<\/p>\n\n\n\n<p>2007 y\u0131l\u0131nda TMSF bor\u00e7 tasfiyesi i\u00e7in DTM projesini \u201cEge D\u00fcnya Ticaret Merkezi Ticari ve Ekonomik B\u00fct\u00fcnl\u00fc\u011f\u00fc\u201d ad\u0131 alt\u0131nda bir yap\u0131 olu\u015fturarak sat\u0131\u015fa \u00e7\u0131karm\u0131\u015fsa da hem ortakl\u0131\u011f\u0131n hem de belediye y\u00f6netiminin kar\u015f\u0131 \u00e7\u0131kmas\u0131 sonucunda 6 Eyl\u00fcl 2007 tarih, 2007\/454 say\u0131l\u0131 fon kurulu karar\u0131 ile sat\u0131\u015f durdurulmu\u015ftur.<\/p>\n\n\n\n<p>2009 y\u0131l\u0131na gelindi\u011finde ise, \u0130BB ve ortakl\u0131k aras\u0131nda yeni bir protokol imzalanm\u0131\u015f, protokol ile s\u00f6zle\u015fme konusu b\u00fcy\u00fck\u015fehir belediye pay\u0131n\u0131n %30&#8217;u Belediye Hizmet Alan\u0131 (BHA) olarak belediye hizmet binas\u0131 yap\u0131lmas\u0131, kalan %70\u2019inin de ortakl\u0131\u011fa ait Merkezi \u0130\u015f Alan\u0131 (M\u0130A) olmas\u0131 \u015feklinde karar al\u0131nm\u0131\u015ft\u0131r. Yap\u0131lan protokol\u00fcn 8. maddesinde bu h\u00fck\u00fcmler \u00e7er\u00e7evesinde ek bir s\u00f6zle\u015fme yap\u0131laca\u011f\u0131 da ayr\u0131ca kararla\u015ft\u0131r\u0131lm\u0131\u015ft\u0131r. Ek s\u00f6zle\u015fme yap\u0131ld\u0131ktan sonra tapuda yeni projeye uygun olarak kat irtifak\u0131 tesis edilmi\u015ftir. Belediyenin hissesindeki &#8220;art\u0131\u015f&#8221;, sadece protokol\u00fcn par\u00e7as\u0131 olarak kalm\u0131\u015f, tapudaki hisse da\u011f\u0131l\u0131m\u0131nda herhangi bir de\u011fi\u015fiklik yap\u0131lmam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Protokol de\u011fi\u015fikli\u011fini takiben 2009 y\u0131l\u0131nda \u0130BB Meclisi yeni protokol ko\u015fullar\u0131na g\u00f6re haz\u0131rlanan naz\u0131m imar plan\u0131n\u0131 onaylam\u0131\u015ft\u0131r. Bu plan ile K\u00fclt\u00fcrel Tesis Alan\u0131 plandan \u00e7\u0131kar\u0131larak yerine Kentsel B\u00f6lgesel Merkezi \u0130\u015f Alan\u0131 (M\u0130A) ve Belediye Hizmet Alan\u0131 (BHA) karar\u0131 getirilmi\u015ftir. Plana emsal de\u011feri yerine, toplam 104.000 m\u00b2 in\u015faat alan\u0131 notu i\u015flenmi\u015ftir. Bu da zaten 5 emsale kar\u015f\u0131l\u0131k gelmektedir. Son iptal edilen planda 4,5\u2019e d\u00fc\u015f\u00fcr\u00fclm\u00fc\u015f olan emsal, yeniden 5\u2019e \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r. Bu onaylanan plana a\u00e7\u0131lan dava k\u0131sa s\u00fcrede karara ba\u011flanm\u0131\u015f ve plan\u0131n\u0131n y\u00fcr\u00fctmesi durdurulmu\u015ftur. Bu s\u00fcre\u00e7te Konak Belediyesi taraf\u0131ndan haz\u0131rlanan 1\/1000 \u00f6l\u00e7ekli uygulama imar plan\u0131, naz\u0131m plan\u0131n\u0131n y\u00fcr\u00fctmesi durduruldu\u011fu i\u00e7in onaylanmam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>2010 y\u0131l\u0131nda kent merkezi ile alan\u0131 da kapsayan Konak Alsancak 1. Etap 1\/5000 \u00f6l\u00e7ekli naz\u0131m imar plan\u0131 onanm\u0131\u015ft\u0131r. Bu plana kadar Alsancak b\u00f6lgesi y\u0131llarca par\u00e7ac\u0131l planlar ile yap\u0131la\u015fm\u0131\u015ft\u0131r. Alan, \u00d6zel Proje Alan\u0131 (\u00d6PA) olarak plana d\u00e2hil edilmi\u015ftir. A\u00e7\u0131lan dava sonucunda yerel mahkeme jeolojik et\u00fctleri bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle plan\u0131n y\u00fcr\u00fctmesini 2011 y\u0131l\u0131nda \u00f6nce durdurmu\u015f, sonras\u0131nda ise iptal etmi\u015ftir.<\/p>\n\n\n\n<p>Uzunca bir s\u00fcre i\u015flem yap\u0131lmayan alanda 2013 y\u0131l\u0131nda Konak Belediyesi taraf\u0131ndan 104.000 m\u00b2 in\u015faat alan\u0131 ve y\u00fcksekli\u011fin serbest oldu\u011fu yap\u0131la\u015fma ko\u015fullu Turizm-Ticaret Alan\u0131 (TT) 1\/1000 \u00f6l\u00e7ekli uygulama imar plan\u0131n\u0131 onaylanm\u0131\u015ft\u0131r. Plan notlar\u0131na g\u00fcn\u00fcn yap\u0131la\u015fma taleplerine uygun olarak \u201ctoplam in\u015faat alan\u0131n\u0131n 1\/3\u2019\u00fcn\u00fc ge\u00e7memek \u00fczere konut\u201d yap\u0131labilece\u011fi maddesi ile kamu yarar\u0131n\u0131 sa\u011flayabilmek i\u00e7in de \u0130BB hizmet binas\u0131 yap\u0131lmas\u0131 amac\u0131yla 31.200 m\u00b2 alan ayr\u0131laca\u011f\u0131 ve zemin alt\u0131 otopark alanlar\u0131n\u0131n 8.500 m\u00b2\u2019sinin \u0130BB\u2019ye ait olaca\u011f\u0131 maddesi eklenmi\u015ftir. Bir ay sonra \u00fcst \u00f6l\u00e7ekli naz\u0131m imar plan\u0131 olmadan 1\/1000 \u00f6l\u00e7ekli uygulama imar plan\u0131 \u0130BB taraf\u0131ndan da uygun bulunarak onaylanm\u0131\u015ft\u0131r. Ayr\u0131ca iptal edilmi\u015f olan Konak 1. Etap naz\u0131m imar plan\u0131 da revize edilerek ayn\u0131 y\u0131l onaylanm\u0131\u015ft\u0131r. \u00d6nceki planda \u00d6PA planl\u0131 olan alan, yeni planda ise TT (Turizm \u2013 Ticaret) planl\u0131 olarak yer alm\u0131\u015ft\u0131r. Bir\u00e7ok kamu kurulu\u015fu ile meslek odalar\u0131 naz\u0131m imar plan\u0131na ask\u0131dayken itiraz etmi\u015f ancak itirazlar\u0131 kabul g\u00f6rmemi\u015ftir.<\/p>\n\n\n\n<p>Di\u011fer yandan, 2009 y\u0131l\u0131nda yap\u0131lan protokol kapsam\u0131nda al\u0131nan kararlar 10.02.2014 tarihli yap\u0131lan s\u00f6zle\u015fme ile s\u00f6zle\u015fme kapsam\u0131na al\u0131nm\u0131\u015f ve protokol konusunda belirlenen h\u00fck\u00fcmler s\u00f6zle\u015fmeye eklenmi\u015ftir. \u00a0<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"403\" height=\"849\" src=\"https:\/\/kalkinmaguncesi.izka.org.tr\/wp-content\/uploads\/2021\/07\/image-18.png\" alt=\"\" class=\"wp-image-928\" srcset=\"https:\/\/kalkinmaguncesi.izka.org.tr\/wp-content\/uploads\/2021\/07\/image-18.png 403w, https:\/\/kalkinmaguncesi.izka.org.tr\/wp-content\/uploads\/2021\/07\/image-18-142x300.png 142w\" sizes=\"auto, (max-width: 403px) 100vw, 403px\" \/><figcaption>G\u00f6rsel 1: Alan\u0131n G\u00fcn\u00fcm\u00fczdeki \u0130mar Plan\u0131 Notlar\u0131<\/figcaption><\/figure><\/div>\n\n\n\n<p>TMSF taraf\u0131ndan 2013 y\u0131l\u0131nda \u00e7\u0131k\u0131lan sat\u0131\u015f ihalesi fon kurulu taraf\u0131ndan ikinci kez iptal edilmi\u015ftir. Planlama kararlar\u0131 sonras\u0131 ortakl\u0131k taraf\u0131ndan in\u015faata ba\u015flanmas\u0131na y\u00f6nelik herhangi bir geli\u015fme olmay\u0131nca TMSF\u2019nin 2014 y\u0131l\u0131nda \u00e7\u0131kt\u0131\u011f\u0131 \u00fc\u00e7\u00fcnc\u00fc ve d\u00f6rd\u00fcnc\u00fc ihaleye de kat\u0131lan olmam\u0131\u015ft\u0131r. 2016 y\u0131l\u0131nda yap\u0131lan be\u015finci sat\u0131\u015f ihalesinde alan, fon kurulunun 24.03.2016 tarih ve 2016\/43 say\u0131l\u0131 Karar\u0131 ile 80 milyon dolar muhammen bedel ile ihale edilmi\u015ftir. Yat\u0131r\u0131mc\u0131 taraf\u0131ndan 3 alternatif proje (G\u00f6rsel 2) haz\u0131rlanm\u0131\u015f, g\u00f6rselleri kamuoyuyla payla\u015f\u0131lm\u0131\u015ft\u0131r. Kurul taraf\u0131ndan onaylanmas\u0131ndan itibaren 30 ay ge\u00e7mesine ra\u011fmen in\u015faat ruhsat\u0131n\u0131n al\u0131namamas\u0131 nedeniyle ihale 18.04.2019 tarihli ve 238 say\u0131l\u0131 fon kurulu karar\u0131 ile iptal edilmi\u015ftir. Bunlardan ilki \u0130BB taraf\u0131ndan Konak il\u00e7esinde yap\u0131lan yeni naz\u0131m imar plan\u0131d\u0131r. Alsancak Liman\u0131n\u0131n giri\u015f k\u0131sm\u0131ndan ba\u015flayarak, do\u011fuda Alsancak Gar\u0131 ve demiryolu, bat\u0131da \u0130zmir K\u00f6rfezi, g\u00fcneyde Fevzipa\u015fa ve Gazi Caddeleri ile s\u0131n\u0131rlanan alanda; 1\/25000 \u00f6l\u00e7ekli \u0130zmir B\u00fcy\u00fck\u015fehir B\u00fct\u00fcn\u00fc \u00c7evre D\u00fczeni Plan\u0131 do\u011frultusunda, <strong><em>Konak 1. Etap (Alsancak-Kahramanlar B\u00f6lgesi) 1\/5000 \u00f6l\u00e7ekli Naz\u0131m \u0130mar Plan\u0131 ve Plan A\u00e7\u0131klama Raporu<\/em><\/strong> oybirli\u011fi ile 12.02.2021 tarih ve 175 say\u0131l\u0131 meclis karar\u0131yla uygun bulunmu\u015ftur.<a href=\"#_ftn1\">[1]<\/a> Bu plan de\u011fi\u015fikli\u011fi ask\u0131ya \u00e7\u0131km\u0131\u015f, itirazlar belediye meclisinde g\u00f6r\u00fc\u015f\u00fclerek karar ba\u011flanm\u0131\u015f ve plan kesinle\u015fmi\u015ftir.<\/p>\n\n\n\n<p>\u0130kinci geli\u015fme ise; 20.02.2020 tarihinde Resmi Gazetede yay\u0131nlanan<a href=\"#_ftn2\">[2]<\/a> kanun ile 3194 say\u0131l\u0131 imar kanununda yap\u0131lan de\u011fi\u015fikliktir. Bu kanun de\u011fi\u015fikli\u011fi ile imar planlar\u0131nda bina y\u00fcksekliklerinin serbest olarak belirlenemeyece\u011fi, sanayi alanlar\u0131, ibadethane alanlar\u0131 ve tar\u0131msal ama\u00e7l\u0131 silo yap\u0131lar\u0131 hari\u00e7 olmak \u00fczere imar planlar\u0131nda serbest olarak belirlenmi\u015f y\u00fckseklikler, emsal de\u011ferde de\u011fi\u015fiklik yap\u0131lmaks\u0131z\u0131n \u00e7evredeki mevcut te\u015fekk\u00fcller ve siluet dikkate al\u0131narak, imar plan\u0131 de\u011fi\u015fiklikleri\/revizyonlar\u0131 yap\u0131lmak suretiyle ilgili idare meclis karar\u0131 ile belirlenebilece\u011fi h\u00fckme ba\u011flanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Konak Belediyesi\u2019nin \u00e7evre yap\u0131la\u015fmay\u0131 da dikkate alarak ilgili de\u011fi\u015fikli\u011fi 1\/1000 \u00f6l\u00e7ekli uygulama imar plan\u0131nda 2021 Temmuz ay\u0131na kadar yapmas\u0131 gerekmektedir. \u0130lgili de\u011fi\u015fikli\u011fin yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na y\u00f6nelik belediyeye yap\u0131lan ba\u015fvurulara halen cevap verilmemi\u015f olmas\u0131 nedeniyle alanda y\u00fcksekli\u011fin ka\u00e7 olarak belirlendi\u011fi bilinmemektedir. Bu konuda belediyenin internet sayfas\u0131nda<a href=\"#_ftn3\">[3]<\/a> da alanda y\u00fckseklik d\u00fczenlenmesine y\u00f6nelik bir plan de\u011fi\u015fikli\u011fi karar\u0131 bulunmamaktad\u0131r. Belediyenin bu alanda y\u00fcksekli\u011fi nas\u0131l belirleyece\u011fi alan\u0131n gelece\u011fi a\u00e7\u0131s\u0131ndan \u00e7ok \u00f6nemli olacakt\u0131r.<\/p>\n\n\n\n<p>Ayn\u0131 \u015fekilde planlama s\u00fcre\u00e7lerinde mahkemelerin iptal gerek\u00e7eleri incelendi\u011finde, alan\u0131n kamu kullan\u0131m\u0131ndan \u00e7\u0131kar\u0131larak kentsel yo\u011funlu\u011fa etkisi olacak y\u00fcksek ve yo\u011fun yap\u0131la\u015fma karar\u0131 getirilmesinin belirleyici oldu\u011fu g\u00f6r\u00fclmektedir. Y\u00fcksekli\u011fin s\u0131n\u0131rland\u0131r\u0131lmas\u0131 asl\u0131nda en ba\u015f\u0131ndan bu yana alanda olmas\u0131 gereken bir karar\u0131n kanunla yerine getirilmesi anlam\u0131na gelmektedir. Bu plan de\u011fi\u015fikli\u011fi belediye meclisi taraf\u0131ndan alan\u0131n gelece\u011fini kurtaracak ve yeniden mahkeme kararlar\u0131na gerek kalmayacak \u015fekilde titizlikle ele al\u0131nmal\u0131 ve karara ba\u011flanmal\u0131d\u0131r. Parsel baz\u0131nda \u00e7al\u0131\u015fma yap\u0131lmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilmelidir. Bu noktada kent merkezi \u201cNe olmal\u0131d\u0131r?\u201d ya da \u201cNe olacakt\u0131r?\u201d karar\u0131n\u0131n verilmesi gerekmektedir. Konak-Alsancak-Basmane \u00fc\u00e7geninde kent merkezi ve devam\u0131nda Alsancak Liman\u0131\u2019n\u0131n gelece\u011finin nas\u0131l planlanaca\u011f\u0131 ortaya konmal\u0131d\u0131r. Bunlar\u0131n cevab\u0131n\u0131 bulmadan parsel baz\u0131nda yap\u0131lacak bir \u00e7\u00f6z\u00fcm bizi hi\u00e7bir \u015fekilde do\u011fruya ula\u015ft\u0131rmayacakt\u0131r.<\/p>\n\n\n\n<p>Y\u00fcksekli\u011fin ve yo\u011funlu\u011fun do\u011fru bir \u015fekilde belirlenmesi alandaki \u00e7\u00f6z\u00fcme ula\u015fmak ad\u0131na ne kadar \u00f6nemliyse alan\u0131n g\u00fcn\u00fcm\u00fczdeki mezbelelik halinden de kurtulmas\u0131 ayn\u0131 derecede gereklidir. Alanda yap\u0131lan kaz\u0131 nedeniyle olu\u015fan \u00e7ukurun su ile dolmas\u0131 bir yandan \u00e7evresi i\u00e7in tehlike olu\u015ftururken di\u011fer yandan da 20 y\u0131l \u00f6nce yap\u0131lan ve y\u0131llard\u0131r bu su i\u00e7inde kalan iksa sistemine de zarar vermektedir. Bu hali ile sadece \u00e7evresindeki binalar a\u00e7\u0131s\u0131ndan de\u011fil, yoldan ge\u00e7en ara\u00e7lar ve yayalar i\u00e7in de risk ta\u015f\u0131maktad\u0131r.<\/p>\n\n\n\n<p><strong>Basmane \u00c7ukurundan \u00c7\u0131k\u0131\u015f<\/strong><\/p>\n\n\n\n<p>Alan\u0131n 1997 y\u0131l\u0131nda kamudan \u00f6zel sekt\u00f6re devri kar\u015f\u0131l\u0131\u011f\u0131nda her ne kadar nakit para al\u0131n\u0131p belediye b\u00fct\u00e7esine kat\u0131lm\u0131\u015fsa da \u00f6denen mebla\u011f\u0131n g\u00fcn\u00fcm\u00fczdeki kar\u015f\u0131l\u0131\u011f\u0131 10.283.736 dolard\u0131r<a href=\"#_ftn4\">[4]<\/a>. T\u00fcm yap\u0131lanlar topland\u0131\u011f\u0131nda alan i\u00e7in harcanan bedelin alan\u0131n %88 oran\u0131ndaki k\u0131sm\u0131n\u0131n \u00f6zel m\u00fclkiyete devrini kar\u015f\u0131lamak i\u00e7in yeterli olmad\u0131\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclmektedir.
