{"id":1164,"date":"2026-03-02T10:44:06","date_gmt":"2026-03-02T10:44:06","guid":{"rendered":"https:\/\/kalkinmaguncesi.izka.org.tr\/?p=1164"},"modified":"2026-03-02T10:45:10","modified_gmt":"2026-03-02T10:45:10","slug":"avrupa-birligi-yapay-zeka-yasasi-getirilen-yukumlulukler-uzerine","status":"publish","type":"post","link":"https:\/\/kalkinmaguncesi.izka.org.tr\/index.php\/2026\/03\/02\/avrupa-birligi-yapay-zeka-yasasi-getirilen-yukumlulukler-uzerine\/","title":{"rendered":"Avrupa Birli\u011fi Yapay Zek\u00e2 Yasas\u0131 \u2013 Getirilen Y\u00fck\u00fcml\u00fcl\u00fckler \u00dczerine"},"content":{"rendered":"\n<p class=\"has-black-color has-cyan-bluish-gray-background-color has-text-color has-background\"><strong><strong>\u0130lker \u00d6TEGEN<\/strong><\/strong><br><em>Uzman<\/em><br><em>Yenilik ve Giri\u015fimcilik Politikalar\u0131 Birimi<br><\/em><a href=\"mailto:ilker.otegen@izka.org.tr\">ilker.otegen@izka.org.tr<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>I. <\/strong><strong>Giri\u015f<\/strong><\/h3>\n\n\n\n<p>Yapay zeka sistemleri, OECD tan\u0131m\u0131na g\u00f6re a\u00e7\u0131k veya \u00f6rt\u00fcl\u00fc ama\u00e7larla ald\u0131\u011f\u0131 girdilerden tahminler, i\u00e7erik, \u00f6neriler ya da kararlar gibi fiziki ya da sanal ortamlar\u0131 etkileyebilecek \u00e7\u0131kt\u0131lar\u0131n \u00fcretim yollar\u0131n\u0131n \u00e7\u0131kar\u0131m\u0131n\u0131 yapan makine bazl\u0131 bir sistemdir (OECD, 2024).<\/p>\n\n\n\n<p>Yapay zeka sistemlerinin d\u00fczenlenmesi konusunda farkl\u0131 e\u011filimler g\u00f6zlenmektedir. \u00c7in, sadece belirli yapay zeka sistemlerine y\u00f6nelik d\u00fczenlemeler yaparken ABD, yapay zeka hakk\u0131nda standartlar\u0131 geli\u015ftirme konusunda federal otoriteleri \u00f6ne \u00e7\u0131karm\u0131\u015f AB ise bu konuyu d\u00fczenleyen bir yasa \u00e7\u0131karmay\u0131 tercih etmi\u015ftir (Carney vd., 2024). Bu yaz\u0131n\u0131n kapsam\u0131, AB Yapay Zeka Yasas\u0131 \u2013kimi kaynaklarda t\u00fcz\u00fck olarak da ge\u00e7mektedir- kapsam\u0131nda getirilen d\u00fczenlemeleri ve bu alanda \u00fclkemizdeki haz\u0131rl\u0131klara de\u011finerek 24.06.2024 tarihinde sunulan Yapay Zeka Kanun Teklifi hakk\u0131nda k\u0131sa bir de\u011ferlendirme yapmakt\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>II. <\/strong><strong>Yapay Zeka Sistemlerinin Yararlar\u0131 ve Riskleri<\/strong><\/h3>\n\n\n\n<p>Yapay zeka, sahip oldu\u011fu algoritma ve s\u00fcrekli \u00f6\u011frenebilme kabiliyetiyle karma\u015f\u0131k verileri anlaml\u0131 bir \u015fekilde i\u015fleyerek karar alma s\u00fcre\u00e7lerindeki riskleri tespit ederek bu s\u00fcreci kolayla\u015ft\u0131rma gibi yeteneklere sahiptir. \u0130laveten uzmanl\u0131k gerektiren inceleme ve analiz gibi i\u015fleri kendi \u00fczerine alarak, mesle\u011fin gerektirdi\u011fi ve s\u00fcrekli tekrarlanan i\u015flerin s\u00fcresini k\u0131saltmaktad\u0131r (Thomson Reuters Corporation, 2025).<\/p>\n\n\n\n<p>Yapay zeka sistemleri, ara\u015ft\u0131rmalarda yeni fikirlerin ke\u015ffedilmesi ve y\u00fcr\u00fct\u00fclen i\u015flerde sa\u011flanan verimlilik art\u0131\u015f\u0131yla ekonomik b\u00fcy\u00fcme ve \u00fcretkenli\u011fe katk\u0131 sunmaktad\u0131r. Sa\u011fl\u0131k sekt\u00f6r\u00fcnde ila\u00e7 geli\u015ftirme s\u00fcre\u00e7leri, antikor \u00fcretimi ve hastalar\u0131n ger\u00e7ek zamanl\u0131 veriye dayal\u0131 takibiyle erken te\u015fhis s\u00fcre\u00e7lerinde rol \u00fcstlenmektedir. Ayr\u0131ca, iklim de\u011fi\u015fikli\u011fiyle m\u00fccadelede hava durumunun ve deniz seviyesindeki y\u00fckselmelerin anl\u0131k izlenmesini sa\u011flamakta, afet risklerinin belirlenmesi ve y\u00f6netilmesi s\u00fcre\u00e7lerini desteklemektedir (OECD, 2024).<\/p>\n\n\n\n<p>Nitekim AB Yapay Zeka Yasas\u0131\u2019n\u0131n gerek\u00e7e k\u0131sm\u0131nda da yapay zeka sistemlerinin sundu\u011fu faydalara dikkat \u00e7ekilmi\u015f, bu sistemlerin sa\u011fl\u0131k, tar\u0131m, e\u011fitim gibi alanlar ba\u015fta olmak \u00fczere ta\u015f\u0131mac\u0131l\u0131k ve iklim de\u011fi\u015fikli\u011fi gibi alanlarda da \u00f6nemli geli\u015fmeler sa\u011flanmas\u0131na imkan tan\u0131d\u0131\u011f\u0131 vurgulanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Yapay zeka sistemleri, sunmu\u015f oldu\u011fu yararlar kadar \u00e7e\u015fitli riskleri de i\u00e7inde bar\u0131nd\u0131rmaktad\u0131r. Bu sistemler, ikna edici ve geni\u015f kitlelere yay\u0131labilecek i\u00e7erik \u00fcretimleriyle dezenformasyonu kolayla\u015ft\u0131rmakta, \u00fcretebildi\u011fi yaz\u0131l\u0131mlarla, oltalama gibi siber sald\u0131r\u0131lar\u0131n daha k\u0131sa s\u00fcrede yap\u0131labilmesini sa\u011flamaktad\u0131r. Finans, askeri sistemler ve ula\u015f\u0131m gibi kritik sekt\u00f6rlerde yapay zeka sistemlerinin yeterli g\u00fcvencelere sahip olmadan kullan\u0131lmas\u0131 ciddi sonu\u00e7lar do\u011furabilecektir. Ayr\u0131ca yapay zeka sistemleri, ki\u015filerin temel hak ve \u00f6zg\u00fcrl\u00fckleri a\u00e7\u0131s\u0131ndan da \u00e7e\u015fitli riskler ta\u015f\u0131maktad\u0131r. Zira bu sistemler, g\u00f6r\u00fcnt\u00fc tan\u0131ma ve \u00e7\u0131kar\u0131m yapma yetenekleriyle ki\u015filerin siyasi g\u00f6r\u00fc\u015f\u00fc, konu\u015fmalar\u0131 ve y\u00fczleri gibi ki\u015fisel verilerini s\u0131n\u0131fland\u0131rarak ki\u015filerin toplant\u0131 ve ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn k\u0131s\u0131tlanmas\u0131na ve ayr\u0131mc\u0131l\u0131\u011f\u0131n derinle\u015fmesine neden olabilir (OECD, 2024). Bu risklere, AB Yapay Zeka Yasas\u0131 gerek\u00e7esinde de de\u011finilmi\u015f ve yapay zeka sistemlerinin ekonomik, toplumsal ve ki\u015filerin temel hak ve \u00f6zg\u00fcrl\u00fckleri a\u00e7\u0131s\u0131ndan risklerinin bulundu\u011fu ifade edilmi\u015ftir.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>III. <\/strong><strong>AB Yapay Zeka Yasas\u0131<\/strong><\/h3>\n\n\n\n<p>Avrupa Birli\u011fi Yapay Zeka Yasas\u0131, Birlik d\u00fczeyinde y\u00fcr\u00fct\u00fclen politika \u00e7al\u0131\u015fmalar\u0131n\u0131n sonucunda olu\u015fturulmu\u015ftur. Yapay zeka alan\u0131nda belirsizlikleri gidermek ve i\u00e7 pazarda ortak bir standart tesis etmek amac\u0131yla Avrupa Komisyonu 2018\u2019de AB Yapay Zeka Stratejisi\u2019ni yay\u0131nlam\u0131\u015f, ard\u0131ndan etik standartlar\u0131n belirlenmesi i\u00e7in uzmanlar g\u00f6revlendirilmi\u015ftir. Bu s\u00fcrecin \u00e7\u0131kt\u0131lar\u0131 aras\u0131nda 2019\u2019da <em>G\u00fcvenilir Yapay Zeka i\u00e7in Etik \u0130lkeler<\/em> raporu ve 2020\u2019de Yapay Zeka Politika Belgesi yer almaktad\u0131r (Feldstein, 2024). Nitekim 2021\u2019de AB Yapay Zeka Yasas\u0131, taslak olarak ortaya konmu\u015f, 13 Haziran 2024\u2019te yasala\u015fm\u0131\u015ft\u0131r. Yasan\u0131n baz\u0131 h\u00fck\u00fcmleri y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015f olup, t\u00fcm h\u00fck\u00fcmleri 2 A\u011fustos 2026\u2019dan itibaren y\u00fcr\u00fcrl\u00fc\u011fe girecektir.<\/p>\n\n\n\n<p>AB Yapay Zeka Yasas\u0131\u2019n\u0131n temel amac\u0131 insan merkezli ve g\u00fcvenilir yapay zeka sistemlerinin kullan\u0131m\u0131n\u0131 te\u015fvik ederek i\u00e7 pazar\u0131n i\u015flevselli\u011fini iyile\u015ftirirken yapay zeka sistemlerinin zararlar\u0131na kar\u015f\u0131 Avrupa Birli\u011fi Temel Haklar Bildirgesi\u2019ne i\u00e7kin sa\u011fl\u0131k, g\u00fcvenlik, demokrasi, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc ve \u00e7evre gibi de\u011ferlerin korunmas\u0131n\u0131 sa\u011flamakt\u0131r (m.1\/1).<\/p>\n\n\n\n<p>Bu kapsamda yasada yapay zeka sistemlerinin tabi olaca\u011f\u0131 kurallar belirlenirken risk bazl\u0131 bir de\u011ferlendirme yap\u0131larak temelde d\u00f6rt kategori belirlenmi\u015ftir. Bunlar, yasak sistemler, y\u00fcksek riskli sistemler, s\u0131n\u0131rl\u0131 risk i\u00e7eren sistemler ve minimum risk i\u00e7eren sistemlerdir. Bu kategoriler i\u00e7in yasada farkl\u0131 y\u00fck\u00fcml\u00fcl\u00fckler \u00f6ng\u00f6r\u00fcl\u00fcrken genel ama\u00e7l\u0131 yapay zeka modelleri i\u00e7in de bir ayr\u0131m yap\u0131lm\u0131\u015f, sistemik risk i\u00e7eren yapay zeka modellerine ek y\u00fck\u00fcml\u00fcl\u00fckler getirilmi\u015ftir (Council of the European Union, 2025). Y\u00fck\u00fcml\u00fcl\u00fckler, temel olarak sa\u011flay\u0131c\u0131larla kullan\u0131c\u0131lara y\u00f6neliktir.<\/p>\n\n\n\n<p>Yasak sistemler, ki\u015filerin temel haklar\u0131n\u0131n a\u011f\u0131r ihlaline yol a\u00e7acak sistemlerdir. \u00d6rne\u011fin ki\u015filerin davran\u0131\u015flar\u0131ndan sonu\u00e7 \u00e7\u0131kararak ya da tahminler y\u00fcr\u00fcterek bu ki\u015filerin sosyal kredisini hesaplayan, su\u00e7 e\u011filimini analiz eden, internet veya g\u00fcvenlik kameralar\u0131ndan ayr\u0131m g\u00f6stermeksizin ki\u015filerin y\u00fcz verilerini elde eden sistemler yasak kapsam\u0131ndad\u0131r (m.5\/1-d,e).<\/p>\n\n\n\n<p>Yasada \u00f6ng\u00f6r\u00fclen di\u011fer bir kategori ise, y\u00fcksek riskli yapay zeka sistemleridir (m.6 vd.). Bu sistemler ancak ve ancak zorunlu gereksinimleri sa\u011flamalar\u0131 halinde Birlik i\u00e7erisinde kullan\u0131labilecektir. Bu sistemlere d\u00f6n\u00fck bir uygunluk denetimi yap\u0131lacak ve ba\u015far\u0131l\u0131 olanlara CE sertifikas\u0131 verilecektir (m.43 &amp; 48). Bu modeller i\u00e7in sa\u011flay\u0131c\u0131lara \u015feffafl\u0131k y\u00fck\u00fcml\u00fcl\u00fckleri getirilmi\u015ftir. Bunlar; teknik belgelemenin haz\u0131rlanmas\u0131 ve g\u00fcncel tutulmas\u0131, marka ve telif haklar\u0131na uygun hareket tarz\u0131 belirleme ve yetkili mercilerle i\u015fbirli\u011fi yapma y\u00fck\u00fcml\u00fcl\u00fckleridir (m.53 &amp; 54\/3).<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Genel ama\u00e7l\u0131 yapay zeka modellerinin kapsam\u0131, kamu sa\u011fl\u0131\u011f\u0131 ve g\u00fcvenli\u011fi, temel haklar ya da toplumun geneline d\u00f6n\u00fck ger\u00e7ek ya da \u00f6ng\u00f6r\u00fclebilir olumsuz etkiler ortaya \u00e7\u0131karabilece\u011fi d\u00fc\u015f\u00fcn\u00fcl\u00fcyorsa bu modeller sistemik risk i\u00e7ermektedir (EU, 2024, Art.3\/65). Bu durumda yukar\u0131da belirtilen \u015feffafl\u0131k y\u00fck\u00fcml\u00fcl\u00fcklerine ek olarak sistemik riskleri de\u011ferlendirmek ve bunlara \u00e7\u00f6z\u00fcmler bulma, yeterli d\u00fczeyde siber g\u00fcvenlik sa\u011flama gibi y\u00fck\u00fcml\u00fcl\u00fckleri bulunmaktad\u0131r (m.55\/1).<\/p>\n\n\n\n<p>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Yasa kapsam\u0131nda d\u00fczenlenen son alan ise ki\u015filerle etkile\u015fime ge\u00e7ebilen ve g\u00f6r\u00fcnt\u00fc olu\u015fturabilen s\u0131n\u0131rl\u0131 risk kapsam\u0131ndaki sistemlerdir. Bu sistemlerin sa\u011flay\u0131c\u0131lar\u0131n\u0131n, sistemlerle etkile\u015fime ge\u00e7en ki\u015filere y\u00f6nelik bilgilendirme, olu\u015fturulan yaz\u0131, ses, g\u00f6r\u00fcnt\u00fc gibi i\u00e7eriklerin yapay zeka taraf\u0131ndan olu\u015fturuldu\u011funu tespit edilebilir k\u0131lma, deepfake<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> olu\u015fturan i\u00e7eriklerin yapay zeka taraf\u0131ndan haz\u0131rland\u0131\u011f\u0131n\u0131 bildirme y\u00fck\u00fcml\u00fcl\u00fckleri bulunmaktad\u0131r (m.50).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>IV. <\/strong><strong>T\u00fcrkiye\u2019deki Geli\u015fmeler ve Sonu\u00e7<\/strong><\/h3>\n\n\n\n<p>Yapay zeka sistemlerinin d\u00fczenlenmesi bak\u0131m\u0131ndan T\u00fcrkiye\u2019de kanuni bir d\u00fczenleme olmamakla beraber buna y\u00f6nelik ifadelere resmi kurumlar\u0131n \u00e7e\u015fitli belgelerinde rastlanm\u0131\u015ft\u0131r. Cumhurba\u015fkanl\u0131\u011f\u0131 Strateji ve B\u00fct\u00e7e Ba\u015fkanl\u0131\u011f\u0131\u2019n\u0131n 2024 Eyl\u00fcl ay\u0131nda yay\u0131nlad\u0131\u011f\u0131, 2025-2027 y\u0131llar\u0131n\u0131 kapsayan Orta Vadeli Program\u0131\u2019nda mevzuat\u0131n Avrupa Birli\u011fi Yapay Zeka Yasas\u0131 ile uyumla\u015ft\u0131rmaya y\u00f6nelik \u00e7al\u0131\u015fmalar yap\u0131laca\u011f\u0131 ifade edilmi\u015f ancak uyumla\u015ft\u0131rmaya dair detayl\u0131 bilgi verilmemi\u015ftir.<\/p>\n\n\n\n<p>Yapay zeka sistemlerinin d\u00fczenlenmesine dair bir di\u011fer nokta ise, Cumhurba\u015fkanl\u0131\u011f\u0131 Strateji ve B\u00fct\u00e7e Ba\u015fkanl\u0131\u011f\u0131 (2023) taraf\u0131ndan haz\u0131rlanan 12. Kalk\u0131nma Plan\u0131\u2019d\u0131r. Yapay zeka uygulamalar\u0131n\u0131n etik ve hukuki \u00e7er\u00e7evesinin olu\u015fturulaca\u011f\u0131, 2024-2028 y\u0131llar\u0131n\u0131 kapsayan planda bir politika tedbiri olarak yer alm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Yapay zeka sistemleriyle ilgili olarak 24.06.2024 tarihinde \u201cYapay Zeka Kanun Teklifi\u201d verilmi\u015ftir. Komisyon \u00e7al\u0131\u015fmas\u0131 devam eden kanun teklifi incelendi\u011finde, kanun teklifinin gerek\u00e7esinin ve maddelerindeki risk s\u0131n\u0131flamalar\u0131n\u0131n, y\u00fcksek riskli sistemler i\u00e7in uygunluk de\u011ferlendirmesinin \u00f6ng\u00f6r\u00fclmesi gibi temel konular\u0131n AB Yapay Zeka Yasas\u0131\u2019yla paralel oldu\u011fu g\u00f6r\u00fclmektedir. Bununla beraber kanun teklifinin, her ne kadar AB Yapay Zeka Yasas\u0131 ile temel d\u00fczeyde paralel olsa da i\u00e7erik bak\u0131m\u0131ndan yeterli kabul edilemeyece\u011fi ifade edilebilir. Zira kanun teklifi olduk\u00e7a k\u0131sa bir metinden olu\u015fmakta ve bu durum, yapay zeka alan\u0131ndaki d\u00fczenlemelerin asl\u0131nda y\u00f6netmelikler arac\u0131l\u0131\u011f\u0131yla olaca\u011f\u0131n\u0131 g\u00f6stermektedir. Yapay zekan\u0131n sorumlu, verimli ve etik kullan\u0131m\u0131 a\u00e7\u0131s\u0131ndan d\u00fczenlemelere ihtiya\u00e7 duyulmaktad\u0131r. Yapay zekan\u0131n geli\u015fme a\u015famas\u0131nda olan bir teknoloji oldu\u011fu dikkate al\u0131nd\u0131\u011f\u0131nda, geli\u015fmelere ayak uydurabilmek a\u00e7\u0131s\u0131ndan y\u00fcr\u00fctmeye takdir yetkisinin tan\u0131nmas\u0131 anla\u015f\u0131labilir olsa da temel haklara dair risk te\u015fkil edebilecek bir konunun kanun eliyle detayl\u0131ca d\u00fczenlenmesinin daha uygun olaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclmektedir. Kanun teklifinin gerek\u00e7esinde ki\u015fisel verilerin daha iyi korunmas\u0131 amac\u0131 bulundu\u011fu ifade edilse de kanun metninin sadece ama\u00e7 k\u0131sm\u0131nda buna dair ifadeler yer almakta, ba\u015fkaca bir d\u00fczenlemeye yer verilmemektedir. Ayr\u0131ca, yapay zeka kullan\u0131m\u0131 sonucu olu\u015fan zararlar a\u00e7\u0131s\u0131ndan tazminat talep etmek m\u00fcmk\u00fcnd\u00fcr. Bunun yan\u0131nda, ki\u015filerin cezai sorumluluklar\u0131 da g\u00fcndeme gelebilir.<\/p>\n\n\n\n<p>Sonu\u00e7 olarak AB Yapay Zeka Yasas\u0131, risk temelli yakla\u015f\u0131m\u0131yla yasak, y\u00fcksek, s\u0131n\u0131rl\u0131 ve minimum risk kategorileri \u00fczerinden sa\u011flay\u0131c\u0131lar ve kullan\u0131c\u0131lara \u00e7e\u015fitli teknik, \u015feffafl\u0131k ve g\u00fcvenlik y\u00fck\u00fcml\u00fcl\u00fckleri getirmektedir.
